Privacy Policy

Shopping Recife establishes in its Terms of Use and Privacy Policy, the conditions for the usage of their sites and apps and/or its services 

  1. DEFINITIONS: For the purposes of these Terms of Use and Privacy Policy, are considered:

    1. Internet Protocol Address (IP Address): the code assigned to a network terminal to allow your identification, defined according to international parameters.

    2. Cookies:  are files created by the sites that you access. They make your online experience easier saving browsing information

    3. Terminals: computers, laptops, netbook, smartphones, tablets, mall directories and any other device that has an Internet connection.

 

  1. PRIVACY

    1. COLLECTED DATA ABOUT THE USER: “Personal data” are information about the user, which we might identify him/her. The kinds of personal data that we may collect include:

      1. Name, address, e-mail, SSN, ID, telephone, birth date;

      2. Information about the usage of our sites and/or apps by users (some information might be collected automatically, such as IP protocol, IMEI, browser, browser language and time of the access);

      3. It is also possible to collect automatically the user’s location since this permission is activated in your cell phone;

      4. Demographic information, like age, gender, education, and others;

      5. About underageds: full name and birth date

 

    1. WAYS TO COLLECT USER’S DATA: 

Shopping Recife and its companies may collect the user’s information (identifiable or anonymous), as follows:

    1. Through registration made by the user on the site and/or app;

    2. Through the using of cookies or other technology that allows information gathering concerning user’s browsing on the site/app;

    3. When users use the Wi-Fi of the enterprise;

    4. When users interact with the enterprise either directly or indirectly (e.g. via telephone, e-mails, using our services);

    5. When users interact with Shopping Recife via third parties (partner companies and social network platforms) 

 

  1. USAGE OF COLLECTED INFORMATION: 

User’s information are collected, stored, treated, processed and used by Shopping Recife and its companies with the following objectives:

      1. To facilitate access and the usage of resources and functionalities of the site and/or app by users;

      2. To analize the site and/or app’s performance, to measure the audience of the site and/or app, to check user’s browsing habits on the site and/or app, how they got to the site and/or app (e.g. through links from other sites, search engine or directly through the address), to evaluate statistics related to number of hits and usage of site and/or app, its resources and functionalities.

      3. To allow the supply of more customized services and adequate to the needs of the users, such as profile page, updates, relevant contents and advertisements;

      4. To allow the communication among the users and Shopping Recife, including via sending and receiving messages, just like emails, and push messages (personalized messages sent automatically to the clients’ devices), but not restricted to just those; and

      5. To identify the profiles, habits and needs for potential service offers and strategies from Shopping Recife.

      6. Shopping Recife preserves and looks after the user’s privacy, except by means of the user’s own consent, court order, obligation under current legislation 

      7. The user is aware and authorizes that his/her recordings of browsing on the site and/or app be provided to Shopping Recife to its respective partners and/or contractors to be of any service related to site and/or app, not indicating individually the user that allows his/her identification and for the purposes envisaged here. The employees or contractors who misuse these information, violating our Privacy Policy will be subject to penalties provided by the current legislation and by the Code of Conduct from Shopping Recife.

      8. Even though our users request the deletion of their accounts from the site and/or app and other channels from Shopping Recife, Shopping Recife will still keep the user’s personal data to comply with law, court order, fraud prevention (art. 11, II, “a” from General Law of Data Protection “GLDP”, Law nº 13.709/2018), credit protection (art. 7º, X GLPD) and other legitimate interests, in accordance with article 10 from GLPD. After the expiry of the deadline and the legal requirements, they are going to be deleted using safe means of disposing, or used anonymously for statistical purposes.

      9. User may disable cookies through settings options from his/her respective browser. However, if the choice is to refuse cookies the user is aware and recognizes that it’s possible that the site and/or app may not work with all the features.

      10. The user may request information about collected data and stored by Shopping Recife anytime through email EC@shoppingrecife.com.br

 

    1. IMAGES - INCLUDE IN INTELLECTUAL PROPERTY

      1. If the user consider that exists facts or circumstances that represents violation of intellectual property rights, personality rights or other rights, he/she must contact Shopping Recife by email EC@shoppingrecife.com.br reporting the following data: 

 

        1. Personal information: full name, phone number and electronic address of complainant;

        2. Description of alleged activity on site or app and, in particular, when the allegation is about violation of copyrights, precise and complete indication of the protected content and allegedly infringed; and

        3. Facts and/or circumstances that may point the in infringing use of the claimed rights;

      2. Shopping Recife reserves the right to remove, under its sole discretion and at any moment, all website content, regardless of prior notice.

 

    1. THIRD-PARTY LINKS: 

Sites and/or apps may contain links for third-party websites. The user is aware and agrees that these links does not constitute endorsement or sponsorship of the third-party(ies) site(s) and acknowledges to be submitted to Terms of Use and Privacy Policy of the respective site(s).

 

  1. VIOLATIONS: 

The user may not perform the following actions, on account of or by using the site and/or app or Wi-Fi:

    1. Commiting any illegal acts and/or violation of current legislation;

    2. Loading, sending and/or broadcasting of any content that is erotic, pornographic, pedophile, obscene, defamatory, libelous, that may incite crime, drug using, alcoholic beverages consumption or tobacco-related products, physical or moral violence;

    3. Loading, sending and/or broadcasting of any content that promotes or incite prejudice or any form of discrimination, such as hatred or illegal activities;

    4. Threatening, coercion, physical or moral constraint to the other users;

    5. Violation of third-party rights;

    6. Breach of secrecy and privacy of others;

    7. Acts that cause or provide propagation or damage any equipments from Shopping Recife, from its companies and/or third-parties, including viruses or any other devices that might be created;

    8. To practice any acts that, directly or indirectly, as a whole or in part, may damage Shopping Recife, any user and/or third-parties; and

    9. To use any company name, brand, domain name, slogan or expression used as means of advertising or any distinctive sign or intellectual property asset of ownership from Shopping Recife.

 

  1. LIABILITIES: 

The user is solely liable:

    1. For all and any acts or omission performed by him/her from his/her Internet access, to site, app, and/or services;

    2. For all and any content loaded, sent and/or broadcast by him/her to the site and/or app; and

    3. For compensation of all and any damages, directly or indirectly, caused to Shopping Recife, to any other user, or, yet, to any third-party, due to non-compliance with the provisions of this Terms of Use and Privacy Politics or any act performed from your Internet access, to site and/or app.

    4. Under no circumstances, Shopping Recife and/or its enterprises will be liable:

      1. For any act or omission performed and/or damage caused by user resulting from the access to site, app or use of services;

      2. For the misuse of site, app and/or services by any user and/or by the loaded, sent and/or broadcast content to site and/or app by the users;

      3. For failures, technical impossibilities or unavailabilities of the system; and

      4. For the installation of virus on user’s equipment or third parties’ or any other devices that might be created, by the user’s Internet browsing.

    5. The user declares to be aware that all and any sent and/or broadcast content to site and/or app by any user doesn’t represent, in any event, the opinion or vision of Shopping Recife.

    6. If the user breaches any provision of these Terms of Use and Privacy Policy or legal provision, without prejudice to other measures, Shopping Recife may, by itself or through a third-party, at any time, block or remove any user’s account and/or take any other measures that might be necessary to the fulfillment of these Terms of Use and Privacy Policy and to ensure the smooth running of the site and/or app, at any time. This measure might be taken by sole discretion of Shopping Recife, without any prior or subsequent notice or notification to any user or third-party, under any means or form, without prejudice of initiate the appropriate legal measures, suspend or limit the access to site, app and/or services.

 

  1. INTELLECTUAL PROPERTY

    1. It belongs to Shopping Recife and all its enterprises:

      1. every and any software, app or feature implied by Shopping Recife or its enterprises referring to site and/or app;

      2. Visual identity of site and/or app (including the graphic-visual art project of any of its pages); 

      3. The company name, brand, domain name, slogan or expression used as means of advertising or any distinctive sign of your property inserted on site and/or app; and

      4. all and any content created and produced by Shopping Recife, by itself or for third-parties, that may not be used, under any means or forms, by users, without previous authorization.

  2. TOLERANCE: 

Tolerance about the potential non-compliance of any of the provisions from these Terms of Use and Privacy Policy by any user will not constitute any waiver to the right to demand the obligation enforcement, nor forgiveness, nor amendment of what is laid down here.

  1. AMENDMENT TO THE ACCESS AND THE TERMS OF USE AND PRIVACY POLICY: 

Shopping Recife, at any time, to its sole discretion and without any prior or subsequent notice or notification to any user or third-party, may:

    1. Suspend, cancel or terminate the access to site and/or app and

    2. Remove, amend and/or update as a whole or in part the site and/or app as well as its respective contents and/or Terms of Use and Privacy Policy.

    3. Any amendment and/or update of these Terms of Use and Privacy Policy shall take effect from the date of its publication on the Site and/or App and shall be thoroughly observed by Users.

 

  1. LEGISLATION AND JURISDICTION These Terms of Use and Privacy Policy are ruled according to Brazilian law. Any disputes or controversies arising from any acts practiced within the scope of the use of the sites and/or apps by users, including in relation to non-compliance with the Terms of Use and Privacy Policy or by infringement of Shopping Recife rights, of other users and/or third-parties, of intellectual property rights, of secrecy and of personality, shall be sued on Pernambuco State Capital County.

 

  1. ACCEPTING THE TERMS OF USE AND PRIVACY POLICY: By accessing the sites and/or apps, the user fully agrees and accepts the provisions of these Terms of Use and Privacy Policy.
